Terms of Service (Australia)

Business use only — not WHS or legal advice. MySafeOps helps you organise SWMS, permits, registers, and site evidence. You remain solely responsible for work health and safety on your sites, statutory notifications to state regulators, and compliance with model WHS laws and applicable state/territory requirements.

1. Agreement

These Terms govern use of MySafeOps by Australian business customers ("you", "Customer"). By creating an account or subscribing, you agree on behalf of your organisation. The Service is operated from the United Kingdom by a sole trader trading as MySafeOps ("we", "Operator").

2. The Service

Browser-based software for SWMS/RAMS, permits to work, inspections, registers, incidents, exports, and related site documentation. Features may change without notice unless otherwise agreed in writing for Enterprise Plus.

4. Subscriptions and pricing

Paid plans are billed in Australian dollars (AUD) unless otherwise stated on your invoice. Prices shown on the Australian landing page are exclusive of GST unless marked inclusive. We may review list prices once per year (up to 10% at renewal, with at least 30 days' notice) — see §7.5 of the UK master terms incorporated by reference for the same commercial mechanics.

5. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any non-excludable consumer guarantee under the Australian Consumer Law where it applies. The Service is offered primarily to business customers acquiring the Service for business purposes.

6. Privacy and data

Our Privacy policy (Australia) and DPA describe how personal information is handled, including overseas disclosure to UK/EU/US subprocessors.

7. Liability

To the maximum extent permitted by law, the Operator is not liable for incidents, injuries, regulatory penalties, or project losses arising from reliance on templates, automation, or Outputs. Aggregate liability is capped at fees paid in the twelve months before the claim, except where liability cannot be limited by law.

8. Governing law

These Terms are governed by the laws of New South Wales, Australia, unless a signed enterprise agreement specifies otherwise. Courts in New South Wales have non-exclusive jurisdiction.
